OpenAI filed a lawsuit against billionaire Elon Musk on Wednesday, alleging that he has deliberately tried to harm the company through a mix of public criticism, legal threats, and business manoeuvres.
The lawsuit, submitted to a federal court that had recently blocked Musk ’s attempt to challenge OpenAI’s transition to a for-profit model, furthers the ongoing dispute between Musk and the AI company he co-founded.
According to the legal filing, Musk used various tactics — including public posts on X, legal claims, and a failed $97.4 billion takeover bid — to damage OpenAI’s credibility and operations. OpenAI said the takeover offer was not genuine and was merely an attempt to disrupt the company’s growth.
“Through press attacks, malicious campaigns broadcast to Musk’s more than 200 million followers on the social media platform he controls, a pretextual demand for corporate records, harassing legal claims, and a sham bid for OpenAI’s assets, Musk has tried every tool available to harm OpenAI,” the company said in Wednesday’s filing.
Musk, who leads Tesla , SpaceX, and OpenAI rival xAI, has openly criticised OpenAI’s ties with Microsoft . OpenAI claims Musk’s efforts intensified after the success of ChatGPT, which now has over 500 million weekly users and is projected to generate nearly $13 billion in revenue in 2025.
OpenAI is now asking the court to block Musk from further attacks and hold him accountable for the alleged damage. “Musk should be enjoined from further unlawful and unfair action,” the company’s legal team said in the complaint.
The fight between the two sides has often played out in public. Musk has mocked OpenAI, including its Ghibli-style image generator, calling such work a waste of the resources the company once claimed were for noble goals. He also posted on X, “Scam Altman,” while sharing a clip of OpenAI CEO Sam Altman speaking at a US Senate hearing.
